Fwiw the overreach problem is that while a defendant has to intentionally damage property, the law doesn’t clearly state that they have to know the property is religious. One could be convicted for secular graffiti on the side of a mall that included a church.
“He acknowledged some concerns about potential ‘overreach,’ but noted that defendants in these cases would remain eligible for suspended sentences.” Fundamental misunderstanding of how prosecutions work, not to mention the minimal benefit that a suspended sentence is in this state.
