two thoughts upon reading this. first, john roberts might be as much of a MAGA freak as alito and thomas. second, his behavior is IDENTICAL to roger taney’s. like, the road to Trump v. USA is almost exactly the same as the process that produced Dred Scott (gift link)

How Roberts Shaped Trump’s Supreme Court Winning Streak

Behind the scenes, the chief justice molded three momentous Jan. 6 and election cases that helped determine the former president’s fate.

The difference between Roberts and Alito/Thomas was always one about tactics, not goals. Now he’s realized their tactics were or could be made more broadly acceptable.

Congressman Jerry Nadler, who will be Judiciary Committee Chair if Dems take back the House, said there will be 3 things he will do immediately: 1) Expand the Supreme Court to 13 members, 2) Impose term limits of 18 yrs., and 3) Create an enforceable code of ethics. #VoteDem2024

An additional takeaway for me: telling that Roberts may hold an outsized view of his own abilities and/or look down on the rest of his GOP justices because he assigned himself 7 (5 major) majority opinions!

His vote to preserve the Affordable Care Act made for false expectation.

It's also a problem of someone whose education was at Harvard/Harvard Law, then immediately went and clerked for conservative jurists, held some positions in the Reagan admin (working with Ken Starr!!!) and then off to being a judge. Hubris and ignorance of the real world are his hallmarks.

Trump vs. USA undermines Congress & throws the separation of powers into disarray. The ruling itself is a judicial construction, with no constitutional backing & the country will be best served when the case is legislatively overturned. youtube.com/live/tYa6Nts...

Thank you for sharing. Jackson's decision in Fischer makes a lot more sense, though I'm not sure the ultimate outcome of the Jan 6 cases will be any different. Sotomayor's rebuffed attempts to moderate Trump v US are also interesting, but I don't see where there was room to compromise.

If John Roberts were the "institutionalist" we got sold by the fawning SCt press - he would've retired in 2021. Dude is straight MAGA.
