We just started classes at UW. I'm teaching holding vs. dicta tomorrow. Perfect timing. Maybe I'll end the class with this opinion and tell the students that everything we just talked about doesn't apply in the federal courts around here? (FWIW, to me it actually doesn't seem like CA9 is that odd?)
Ironically, I think any statement in an en banc CA9 opinion now that dicta is not binding would itself necessarily be dicta.
Somehow that fits with CA9’s heavier reliance on unpublished opinions
