They're not your friend, and they hate you. They don't care, and they think you're a threat. Gangstalking 3ds homebrew devs is not the behavior of a company that is tolerant. That's the behavior of a company exploiting the law to wipe out the slightest concern.
I feel like emudevs should abandon all pretenses of appearing legal. In general, all Nintendo fans working on projects such as fangames should too. You think it has ever made Nintendo less vitriolic? Even homebrew for consoles they don't sell or profit of from anymore are targeted.
I think the general rule of thumb with nintendo legally is if they think it'll hurt their bottom line, theyll kill it, if not they dont really care (some good examples would be like the entire wii u, 3ds, and wii homebrew scenes & their online restoration projects, ctgpr & 7)
