Yeah, in 2009, that was fair game. I feel a little differently now, but "Google scanned all the books and is making ad money off of them" seemed fine back then.

Except that Google wasn't. And, in fact, "Google isn't making ad money off them" was one of the reasons - and not a small one - that Google's project was fair use.
