You missed the entire point. The entire point is that there has never been, and will never be, a government that will never use the law in such way or be tempted to. Removing that authority from the government is the only way to prevent it.

My point is that this is not unique to speech. When people suffer, they often want their government to “do something.” If a hospital is charging too much, they want their govt. to do something. Now, the govt. could come up with a law that forces the hospital to cut costs. 1/
