Slavery was Legal. Colonialism was Legal. Jim Crow was Legal. Apartheid was Legal. Legality depends on who has power and the kinds of laws they pass to preserve their own privileges and bigoted views. Legality often has nothing to do with justice.

Absolutely, the law should represent the will of the people and if any law does not serve that trust it should be defied in the short term and abolished in the long term.
So many people use the word democracy when what they mean is a constitutional democracy with the rule of law. Too many people think rule of law is policing of any legislated law. We violated our constitutions to codify racism. We got rid of the codes but are left with the systems that built up.
