would probably be a lot easier if more of them were available for digital sale. I think people “on the inside” don’t really account for the fact emulators are too complicated for the layman, who no longer understands concepts like filesystems

It also doesn't help that some of these games are also only available via subscription services. I would love to play The Legend of Zelda Minish Cap on my Switch but you need a Nintendo Switch Online subscription to access it.

Absolutely. I wish these publishers were better "custodians" of their legacy. Instead, folks gotta make due with whatever they can, legal or otherwise.
