Judge Luttig (highly respected retired conservative appeals court judge): SCOTUS majority's reasoning means that "no person who ever engages in an insurrection against the Constitution of the United States in the future will be disqualified" under the 14th Amendment x.com/judgeluttig/...
He was respected. He’s a little nuts now.
Fuck Luttig. He had an opportunity on Jan 6 to be a much more reliable voice, but he chose the bullshit filibuster wish-wash route. Just another asshole trying to save his legacy.
As someone else observed (I'd give credit if I could remember where I saw this) just watch for the flood of J6 rioters who will be running for Congress soon.
I hope a future Court will declare that the part of the opinion that limits action under the Disqualification Clause to legislation is dicta so there will be no difficulty in overruling it.
Ouch. He's gotta take the L on this one. bsky.app/profile/stev...
The more I think about it, the more nuanced I feel it actually is. I think the Court’s ruling due to the wording of the case “on the ballot” is the right ruling. However, I think the challenge is to establish what the fed should do if a “winner” shows up for inauguration that violates 14a.
