In hindsight, we would say the treaty (including the considers under which it was made and even the larger context) was fair? Did all parties actually agree to it, and agree on what it meant? Have the parties maintained their obligations? In very few circumstances is it “yes” to all of those.

Yes! I live on territory that was ceded in a treaty... a treaty that was subsequently broken by colonizers, thus making it void... so I still say "unceded." BUT a lot of places in Canada etc talk about "treaty land" e.g. this one that I found on a quick google aiis.msu.edu/land/
