People talk about how we need to get back to 5-4 to get anything done, but even getting back to 4-5 brings you to the point where you have the change of getting a courtesy fifth on a stay when you have four votes for certiorari.
For those who don’t know: It only takes four justices to decide to hear a case, and it is fairly common practice (although less common these days) for a justice who wouldn’t have granted cert to nonetheless agree to stay a judgment in cases where a stay was needed to not moot the case.
What if we treated killing an innocent person as murder? We should remove all of the murderers from the court and relocate them to jail.
