I'm continually astounded by how obviously 'wrong' so many high profile defamation suits are. If an average layperson with a passing familiarity with LawSky/LawTwitter can look at it for 30 seconds and be like 'this is a loser of a case', why do actual lawyers write them?

My charitable answer is that US defamation law is genuinely counter-intuitive. It's unusual that there are no legal consequences for saying vicious untrue things about someone. The uncharitable answer is that many lawyers aren't very smart nor very ethical.
