Absolutely they should be. I *THINK* it would actually be "reckless homicide" or maybe "negligent homicide" however as far as a charge. A prosecutor would want the charge to potentially be successful, proving murder is going to be more difficult.

Who's going to charge them? Certainly not any prosecutor in the state. Certainly not our current "Justice" Department.
