Now the Court is doing passively what it was unwilling to do actively. By not taking this case, the Court allows TX to criminalize providing emergency care for pregnant ppl. Women will die—and the Court has successfully avoided having to make *any public statement* of how & why it got here. (2/2)

There were no noted dissents from the denial of cert, which means either (a) Justices Jackson, Kagan & Sotomayor didn't vote to hear the EMTALA case or (b) despite voting for cert, none wanted to publicly dissent from the denial of cert. I don't know which it is & they mean different things.
