I am not an expert, but a common remark I hear from the supreme court is that the federal government should just legislate it rather than asking the supreme court to decide it based on existing laws, which do not explicitly require protection for abortion. I think that if voted into law, it stands.

Given that this supreme court has ignored its own precedent and routinely twists history and logic to reach a predetermined outcome, I think you're putting a lot of faith in the ethics of people who appear to have very few (if any).
