one of the strangest things about this piece if you read it is that it takes for granted the idea that trumpā€™s election somehow represented the public will. it also rests on the idea that trump did not try to overturn the results of the previous election through illegal & extra-constitutional means

Thereā€™s a bizarre moral shaming here, where America has to repeatedly reject an already unpopular authoritarian despite a famously byzantine electoral system that keeps electing Presidents with a minority of voter support, or it gets fascism. Itā€™s like Russian roulette with only one chamber empty.

Itā€™s also nonsensical to imply that the purpose of the courts is to reify political consensus.

In deciding against Nixon, the Supreme Court was only reaffirming the political consensus.

It also implicitly states that an amendment wasn't constitutionally agreed upon. Like if everyone just thought it was a good idea we could elect a 21 y/o French exchange student as president.
