The Texas man who filed the first post-Roe lawsuit for wrongful death of a fetus—he sued his ex-wife's friends for helping her get abortion pills—dropped his case last night. The plaintiff was represented by Jonathan Mitchell, the anti-abortion activist who devised Texas's SB8.

From my read of this--while this is a good outcome--is it's not so much about the basic merits of the case under the [insane] statute, but rather the plaintiff's abhorrent related behaviour coming to light. It's not great.

Speaking of Jonathan Mitchell, now is a good time to remember what he said about plans to ban abortion nationwide *without passing a new law* in this NY Times article from February: www.nytimes.com/2024/02/17/u...

Excerpt from a New York Times article about the various ways Trump's allies plan to restrict abortion. This passage mentions the long-unused 1873 federal law (actually, collection of laws) known as the "Comstock Act," which several of these allies read to criminalize shipping any materials used in abortions across state lines. (The article mentions abortion pills specifically but this law, if the executive decided to enforce it and the courts decided it was still in effect, would apply much more broadly and, if interpreted the way these allies urge, could make it impossible to perform any type of abortion anywhere in the United States.)

Jonathan Mitchell states, "We don't need a federal ban when we have Comstock on the books." He then says of Trump, "I hope he doesn't know about the existence of Comstock, because I just don't want him to shoot off his mouth. I think the pro-life groups should keep their mouths shut as much as possible until the election."

This case was some serious (and terrifying) bs. Bro was a domestic abuser who weaponized a horrible law to terrorize women.
