I'm surprised you think that. My assumption is that if they can find the Northern District of Texas, they can get an injunction. I don't know if it will stick, but I can imagine the Fifth Circuit following the reasoning of the dissent.

It bothers me no end that I first saw this picture in an article that spent some time discussing Judge Posner's love of cats and, in particular, Maine Coons. However, THIS IS NOT HOW YOU HOLD A CAT!!! You need to support its hind quarters! C'mon now, this isn't hard.

I think it's both. If memory serves, some people have tried to sue, and the waiver was effective in getting claims dismissed.
Wonderful resource! I need to spend some time with it. I don't know about the Glenwood Caverns case. I mostly pick up on things only once there is a disposition by the courts.
