Check out footnote 2, in which Fulton County trial judge Robert C. I. McBurney tells the Georgia Supreme Court that he is not a fan of their faux modesty and dubious constitutional interpretation.
"But here we are." Indeed.
“But here we are.” Lmaaaoooooo
Ooooooh, that's nice, Max!
AND benchslaps the US Supreme Court.
I've been a Judge McBurney fan since the Tex McIver trial started in 2017. Every time his name comes up I know it's going to be something good!
Admirably lucid writing on a somewhat difficult to articulate idea
Overriding the right to privacy in the Georgia constitution meant that possibility that the sodomy ‘ghost law’ would come back to haunt Georgia.
". . . laws . . ., enacted by legislators long since voted out of office, can spring to life when our ever-changing politics yields a new majority on our high courts, a majority which in turn imparts a new meaning to a supposedly unchanged and unchanging Constitution. But here we are."
"Unsurprisingly (one would think)" 💀
McBurney taking the opportunity to point out, “I’m functionally smarter than the majority of the Supreme Court.”
