Thanks. Yeah, I couldn’t get back to the original statute. The literal text adds “or to be received or used in lieu of lawful money of the United States” after “to circulate as money.” That seems to encompass a check for 30 cents at the grocery store instead of cash.
The law itself was from a USC codification act in 1948 and so I can’t see when it was originally enacted. But I’m guessing it’s from when banks issued their own notes and wildcat state banks may have issued tiny notes hoping people wouldn’t redeem them.
