Interested in people's thoughts, but a solution might be to follow the approach taken by SC in Carmody and prohibit prosecution of the two applicants until the Oireachtas takes steps to address the unconstitutional discrimination identified in the Court's judgment.
As an American I find it incomprehensible that prosecutors could simply wait to prosecute somebody for a crime they've already committed, until they're old enough to be eligible for a longer sentence. If there's a 10 year statute of limitations, could they wait a decade to arrest an 8 year old?
