The impact of the War on Drugs is way oversold. The 1994 Crime Bill is a distraction. Private prisons play almost no role. Any path to real decarceration means taking on some big public sector unions. Some rightwing think-tanks are sincere abt reforms.

Happy Constitution Day! The Constitution is a fascinating example of how unlawful acts can become lawful if the actors win. Existing law required unanimous state consent for amendments to the Article of Confederation. So ā€œweā€ ditched the Articles. It was a (second) revolution.
