Why would a business not be on the hook for that? Businesses are already on the hook for things that an employee does and their inanimate communications like ads and price listings. To my knowledge there's no AI exception.

This is basically my take on it. The business is already liable, and courts typically take a dim view of arguments of the form, "Look, we added a disclaimer to our customer service chatbot to the effect that the little shit might just lie to you, and that transfers the liability to the consumer."
