I wouldn’t let him off so lightly. If someone says transphobic things, it’s on them to prove they’re not a transphobe. And he’s not done that.

A cross-party appointments committee decides? Good point re Musk. The nice property of the HoL right now is that peers aren’t incentivised by electability and can act in what they believe to be the best interests of the country. Perhaps fixed terms would solve that.
No place: hereditary peers, religious leaders. Maybe a place: appointments for life based on skills and not appointed by political affiliation. Fully elected has its problems too, so I’d start by removing the above.
And this new vulnerability is alongside all the already-known weaknesses.
