There is endless legal scholarship about this but contract law has been off the rails for at least three decades thanks to a handful of activist judges deciding to mold the world in the shape of a half-baked econ model. We need sensible public rules for low-friction consumer transactions.

NGL, the news out of NC is really distressing as someone who lived in Jersey City during Sandy. My husband was a USCG officer, & I barely saw him, so my Sandy was carrying my bike up 20+ floors; friends sleeping over; trying to figure out food & gas for weeks. Just refilled our water storage...1/
