There are a lot of variables in the book store analogy. You can sell almost any book you want, but if you are calling a publication news or fact, then there are requirements that aren't applied to other publications. X is a private company, but it has a news section and a large user base.

This makes things murkier. X could potentially cause catastrophic harm in specific circumstances. It has the potential to distort reality. Even an author could be sued if they published a book advising lethal behavior. The book store could also be sued.
