This makes things murkier. X could potentially cause catastrophic harm in specific circumstances. It has the potential to distort reality. Even an author could be sued if they published a book advising lethal behavior. The book store could also be sued.

There are a lot of variables in the book store analogy. You can sell almost any book you want, but if you are calling a publication news or fact, then there are requirements that aren't applied to other publications. X is a private company, but it has a news section and a large user base.

So the test in that case seems to be a lie that causes harm even if the harm was not direct. Even if the people in the theater harmed themselves. That bar is pretty low. Lying about CoVID puts you so high you can't see that bar without a telescope.

The yelling fire comparison was always interesting to me because it is presumed the theater goers would harm themselves. They might just slowly amble out of the room. Also, if there was a fire, it is presumed the shouter would be exercising speech, even if in a poorly chosen way.
