it's the same with SCOTUS for me. the big advantage she initially had from biden from me is that she doesn't necessarily have the same obsession with 70s style bipartisanship and smokey backrooms and "we're all friends here" and "aw, decorum" because she literally wasn't around for that.

i am saying civility is a richer topic than appears if we restrict ourselves to the perfectly legitimate sense of standards of decorum. in a way, i am turning from a deontological angle to one focused on virtue as strength or capacity or power, with the attendant ingredient of a telos.

the real reason we're not is because we lean overwhelmingly democratic, so the republicans don't want us to have that representation and the democrats are too obsessed with decorum and "fairness" to argue otherwise

I guess I'd just say it depends. Usually when folks talk about "norms" they mean them in the sense of political decorum and small-p small-c political conventions about how to behave, which are perhaps shocking to put aside, but aren't unlawful to. But not all norms are equally weighted
