Certainly 1A protects that poster's post and whatever moderation action Bluesky takes. Endorsement of violence, as long as it's not imminent incitement, is protected. See Brandenburg v. Ohio, Skokie v. NSPA, and Virginia v. Black, which clarify what is an illegal threat.

So, this case wasn’t covered by CPIA. I assume it was pursued under the National Stolen Property Act (indicated by the language about falsification and that this was a criminal conviction). There isn’t a statute of limitations under the NSPA; stolen is stolen no matter how long ago.

My completely not-a-crank take on this is that 35 years of terrible pedagogy about Skokie v NSPA has cooked the brains of a generation of people into thinking that the true measure of how free a society is, is how accommodating to literal nazis it is.
