1) if a bus is parked and not taking passengers, it would likely be kept locked in a secure lot. Not a good target for a voyeur. 2) just because they did it in public with the possibility of being caught, it doesn't guarantee that anyone WOULD catch them (or be forced to observe).
Legality and ethics are not synonymous, despite having significant overlap. Just because something is legal doesn't mean it's ethical, and sometimes the law must be ignored to do what's right.
Ultimately, I think that it's reasonable to assume recording is allowed, but those being recorded have every right to request that the recording is either not shared or deleted, especially considering the sensitivity of the material.
Conversely, the lovers could argue that there's a critical difference between observing and recording. While observation is ephemeral and limited to those on the bus, a recording could go much further beyond their control, to people that did NOT get that implicit consent to observe.
