Colorado used to be, the rules have gotten more strict now: candidates have to be nominated by either a major (D and R) or minor party (registered parties that meet registration thresholds), or collect 1500 valid signatures in each of the state's eight US house districts.

I put some limits on magic in my fantasy series- the biggest being there's a limited number of magical disciplines wizards can specialize in (because magic in my series takes years of practice to perform), but I leave the upper limits of what can be done open so I don't write myself into a corner.
