What's up with having to specify that the officer would have known the guy had "a clear established right not to be shot?" Doesn't everyone? Is this something that sounds worse than it is because legal language isn't the same as regular language?

"...clearly established that officer could not use deadly force on a man merely for disobeying police commands." I think a lot of cops fully believe they have QI if they kill a disobedient civilian, same as they kill any dog that exists in a space they enter.

LFG!! The only way to make it stop is to hold them accountable. Then, require cops to have malpractice insurance and use that to pay damages for malpractice events. Insurance companiea won't cover criminal cops who can't do their job free of malpractice events.

QI is bad, and I think part of why is that it assumes police officers keep up to date on what does and doesn’t qualify for QI. Many police officers don’t know what the traffic laws in their state are; why would they be expected to keep up to date on Supreme Court rulings.

6th Cir. also holds that it violated the Fourteenth Amendment for shooting officer to fail to provide first aid after shooting suicidal man, and this too was clearly established law. No QI on the failure to render aid claim. www.opn.ca6.uscourts.gov/opinions.pdf...
