I don't know, so much of this is happening because the Supreme Court is signaling they *want* to the hear appeals. If Harris is bold and empowered enough to pack the court, that'll cut a lot of this nonsense off at the knee.
It's not just the judiciary. Trump has shown other Republican politicians just how far right many American voters are willing to go, so even if he loses next month (hopefully), we have at least a generation of politicians just like him. Or worse.
