Reading the full judgement of the Diarra case at the CJEU (link below), it looks to me that players who wish to terminate their contracts before the agreed date will now be able to do so without fearing draconian punishment. The impact should/will be huge. curia.europa.eu/juris/docume...
I’m struggling a little bit to get my head around what it means in practice. Can players arbitrarily tear up their contracts? Can clubs do the same? Does it mean the end of transfer fees as we know them? I don’t quite understand the implications.
If a player can terminate his contract without penalty. Surely, the football club can also terminate the player's contract without penalty. The days of doing a "Bogarde" could be over.
That's my reading too, but why do you think FIFA say it's trivial? www.bbc.co.uk/sport/footba...
After a long-running dispute between ex-Chelsea and Arsenal midfielder Lassana Diarra and Fifa, a court has ruled against the governing body.
I’m trying to think of the impact: no more transfer fee? Higher salary? Longer contract to receive a higher termination fee?
Does that mean clubs have the same right? If so, contracts become pointless.
