If the scheme was fairly prescriptive in what was eligible, or if government sign-off was needed ahead of the funds being spent, and outcomes measured, then a lot of that could be headed off. As you say, the incentives don't naturally line up, this is saying "get on board or pay a lot of tax".

To me the answer seems clear - let them keep the investment loophole as long as the investment is in clean energy production. Give them the choice between handing those profits over to the government or spending them on building revenue-generating solar and wind farms.
