To confirm a SCTOUS justice requires the Senate to hold a hearing and take a vote. You can't just send a letter to McConnell saying "if you don't confirm our guy by X date then we'll just assume he's confirmed." I mean, I guess you could--but McConnell would just laugh at it and be like "whatever."

You mean like nominating a bland centrist judge in his 60s? There just wasn't anything that was going to work. McConnell had the majority, he controlled the Senate agenda, and wasn't going to face a serious electoral threat. The Dems had to win the election and they didn't.

Well, I’m not sure there’s anything Dems could have done to prevent McConnell from denying a vote on Garland. But regardless who was at fault, with the present federal judiciary the EPA has been severely weakened and agencies will not bring Title VI environmental racism cases for fear of bad law.

Really the Supreme Court is the biggest obstacle. By disabling the administrative state they’ve nerfed a lot of good things the administration was trying to do.
